Terms & Conditions.

 

1. Cancellations

 

1.1 - If the event contract is canceled or postponed by the client with more than 30 days prior to the event, the non-refundable retainer payment will not be returned, it being the agreed loss suffered by LLP due to cancellation. 

 

1.2 - If the event is canceled within 30 days of the event, the full amount(any amount PAID) will become non-refundable.

 

1.3 - In the unlikely event LLP determines that we are unable to complete the coverage due to unforeseen circumstances, a backup photographer will be provided. If no backup can be found, all money (including the deposit/retainer) will be returned to the client.

 

2. Pre-Event/Production Consultation

 

2.1 - The parties agree to a pre-event consultation before the event/production in order to finalize the actual shooting times, locations, and Client’s request list (in writing) for specific photographs. 

 

2.2 - The Client will be responsible for, or have someone designated, to identify people of whom specific photographs are desired. 

 

2.3 - LLP will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for group photographs.

 

3. Payment

 

3.1 - The Client agrees that the Reservation Deposit is required at the time of signing the contract and the Outstanding Balance is due on the day of the event, or on the Outstanding Balance Due date in the Event Package Summary if specified.

 

3.2 - Booking Fees & Retainers

A booking fee/deposit of 50% (or stated otherwise) and a signed contract agreed to the initial terms and conditions as per the website will confirm/block your date & booking. The balance of the total price is due:

 

3.2.1 - Commercial/Corporate/Production:

50% upfront payment fee/deposit/retainer upon acceptance of the quotation.

50% balance upon completion of the project.

3.2.2 - Wedding/Engagement/General Event

RM200 or 30% retainer deposit(whichever is higher) and a signed contract will block your date.

4. Limit of Liability

 

4.1 - In the unlikely event of total photographic failure or cancellation of this contract by either party or in any circumstances, the liability of one party to the other shall be limited to the total value of the contract. 

 

4.2 - Neither party shall be liable for indirect or consequential loss. 

 

4.3 - Any legal matters will be held in the photographer’s home state, any legal fees incurred by the photographer as a result of client prosecution will be paid by the client.

 

5. Copyright, Reproduction, and Model Release

 

5.1 - The copyright of the photographs is retained by LLP at all times throughout the world. Where a digital version of the photographs has been included for the clients as part of the event collection, these photographs will include a print release and may be printed, and or displayed online, for personal/company use. 

 

5.2 - Commercial/media use must be expressly approved in written form by LLP and include a citation. This includes online publications. 

 

5.3 - LLP retains the right to use the photographs for the purpose of advertising or otherwise promotion work. 

 

5.4 - The client agrees not to sell any of the files or prints without written permission from LLP. 

 

5.5 - The client agrees that they are singing a model release to allow the use of the photographs (of themselves) and those pictured at their event for the photographer’s business purposes.

 

6. Social Media/Press Release(newspaper/magazine/online publications)

This clause applies to social media including, but not limited to Twitter, Tik Tok, Facebook, Instagram, newspaper, magazine and blogs(online publications). 

 

6.1 - When published online and offline, it is required that citation/credential of LLP be made. 

 

6.2 - The client agrees that they will under no circumstances alter LLP’s photographs that are placed in public or on the internet. As a photographer, we need photographs to be an accurate representation of our work so that future clients have a good understanding of our brand and style. 

 

6.3 - The client agrees to be responsible for any employee, partner, family member, or friend who posts our photographs online and agrees that they cannot be cropped (with the exception of forced cropping on social media), altered in color, or edited in any way.

 

7. Retention of Delivered Files

 

7.1 - The client will be provided an online gallery (Pixieset gallery/google drive folder) valid for 6 months from the date of final files delivery (minimum 2 weeks or maximum 60 days), where the client can download the original copy of the final files. 

 

7.2 - Once the files are delivered to the client, it is the client’s sole responsibility to protect and retain their images for the future. 

 

7.3 - (For weddings & non-corporate events)

It is highly recommended that USBs be duplicated and stored in multiple locations in cool dry areas. 

 

7.3.1 - LLP agrees that replacement digital copies can be requested up to 1 year after the date received for no additional fee. 

 

7.3.2 - An additional USB can be requested for up to 1 year for an additional RM50 at request. After 1 year from the received date, LLP has the right to refuse to replace digital or USB copies of images.

 

*Deliverable in USB drive only applies for wedding & event products only

 

8. Satisfaction and Accuracy

 

8.1 - The client agrees that the work delivered will be of a similar style and caliber to those photographs on our website and blog and that LLP will have complete creative control during the photographs and in post-processing. 

 

8.2 - The images (videos) will be delivered in JPEG (MP4) format with a mix of color and black and white images, and deemed appropriate by LLP. 

 

8.3 - No re-editing will be done after the final edited copies are presented to the client. 

 

8.4 - The client agrees that LLP can only capture the event that happens: weather, location, schedule complications, time restraints, and the subject’s ability to cooperate, are all factors in the quality of the photographs. 

 

8.5 - LLP will not edit for physical size, hair, or any other physical appearance issue other than blemishes.

9. Interference or Obstruction

 

9.1 - No clients, event guests, attendants, and employees of the client may impede the photographer when he/she is shooting or performing duties; failure to comply may result in missed moments or fewer delivered images. 

 

9.2 - LLP also requests that client requests for all phones, tablets, and cameras be put away during the ceremony(weddings) to capture the best quality images possible. This “unplugged” atmosphere allows no hindrance in the ability to capture spur-of-the-moment reactions and provides better-quality photographs. 

 

9.3 - No other professional photographers will be hired by the client or located on-site to photograph the client during the event unless otherwise informed & approved by LLP. This responsibility will fall on the client to ensure all are in compliance. 

 

9.4 - The private portraits with the bride and groom must remain private, in addition to the photographers of LLP. No other individual may impede on this moment. 

 

9.5 - Lighting deficiencies at venues may interfere with the photographer’s ability, all attempts to provide adequate lighting situations must be made by the client.

 

10. Food and Breaks (applies corporate event/wedding/general event)

 

10.1 - The photographers will be allowed 20-minute breaks at their own discretion and bathroom breaks when necessary. 

 

10.2 - Each photographer will be provided a full guest meal for an event lasting longer than 5 hours. 

 

10.3 - If no meal is provided the photographers reserve the right to go off-site for a meal for 45 minutes. 

 

10.4 - It is highly recommended that the photographers are allowed a meal directly after or before the event/bridal party to ensure they are finished eating by the time the next activity is scheduled.

 

 

 

 

***Special & Important Notes.

Due to the pandemic time/season, the photo/videographer will not entertain any request by the client’s guests to take photos using their personal devices. The photo/videographer will adhere to every possible SOP set by MOH & MKN.

This is a contract for corporate/personal photography services to be provided by LLP and/or individuals subcontracted to do work for LLP. The Parties agree to the above terms and conditions and acknowledge that they have received, read, and understand LLP’s current price list.
